1. Acceptance of Terms
By accessing and using Somber People (the "Platform"), you accept and agree to be bound by these Terms and Conditions. If you do not agree, you may not use the Platform.
2. Eligibility
You must be at least 16 years old to use this Platform. By registering, you represent that you meet this age requirement and have the legal capacity to enter into binding agreements.
3. Verification of Organizations
All brands, agencies, startups, and organizations listed on our Platform undergo a verification process. We reserve the right to reject or remove any organization that fails verification or is found to engage in fraudulent, misleading, or spam-related activities. Verified status does not constitute an endorsement.
4. Talent Profiles
Talent users are responsible for the accuracy of their profiles. Profiles must represent real individuals seeking authentic opportunities. Misrepresentation of identity, skills, or experience is prohibited and may result in account termination.
5. Campaigns and Payments
Posting a campaign requires a valid subscription or one-time payment. All fees are displayed on the paywall page prior to purchase. Payments are processed securely through our payment provider. Refunds are issued at our discretion in accordance with our refund policy.
6. Prohibited Conduct
Users must not: (a) post false or misleading information; (b) engage in fraud or scam activities; (c) send unsolicited spam communications; (d) harass or discriminate against other users; (e) attempt to circumvent payment or verification systems; (f) use the Platform for any illegal purpose.
7. Intellectual Property
All content on the Platform, including text, graphics, logos, and software, is the property of Somber People or its licensors and is protected by intellectual property laws. Users retain ownership of their profile content but grant the Platform a license to display it for operational purposes.
8. Limitation of Liability
Somber People is not liable for any indirect, incidental, or consequential damages arising from the use of the Platform. We do not guarantee specific outcomes from campaigns or applications. The Platform is provided on an "as is" basis.
9. Account Termination
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or compromise the integrity of the Platform. Upon termination, your right to use the Platform ceases immediately.
10. Changes to Terms
We may update these Terms periodically. Continued use of the Platform after changes constitutes acceptance of the revised Terms. We will notify users of significant changes via email or Platform notification.
11. Governing Law
These Terms are governed by the laws of the jurisdiction in which Somber People operates. Any disputes shall be resolved in the courts of that jurisdiction.
